Terms of Use & Privacy Notice
Please read this information before using Tender Partner. Acceptance is required to continue using the service.
1. Agreement and authority
By selecting “I agree” and using the website, you confirm that you have read, understood and accepted these Terms. You must be at least 18 years old and legally capable of accepting them. If you use Tender Partner for a company or other organisation, you confirm that you are authorised to act for that organisation.
2. What Tender Partner provides
Tender Partner helps users discover, organise and review publicly available tender and request-for-quotation information. It may also provide search filters, deadline tools, requirement indicators, document links, bid-pipeline tools, quotation and invoice tools, support services, and introductions relating to purchase-order funding.
Tender Partner is an information and workflow aid. It is not a procurement authority, legal adviser, financial adviser, tender-award decision maker or representative of any buyer.
3. Public sources and official verification
Opportunity information may be collected, displayed or summarised from publicly accessible sources, including the South African eTender Publication Portal and notices published by organs of state or other buyers. Tender Partner may reformat or classify this information to improve usability.
- The buyer's official notice, addenda and procurement documents remain authoritative.
- Public information can be corrected, withdrawn, re-advertised, cancelled or delayed without notice to Tender Partner.
- You must verify the reference number, eligibility, briefing session, deadline, delivery requirements, contact details and documents directly against the official source before responding.
4. Estimated values and competition indicators
Any estimated tender value, value range, affordability indicator or similar figure generated by Tender Partner is an experience-enhancing estimate only. It is not an official budget, quotation, award amount, commitment or guaranteed contract value. Actual values may be materially higher, lower, undisclosed or not applicable.
Any competition indicator, difficulty level, requirement level, match score or opportunity rating is produced from selected data points, rules or computational matrices. It may be incomplete or inaccurate and cannot predict the number, identity, eligibility, price or quality of competing bidders. Tender Partner has no inside procurement information and does not guarantee the accuracy of these indicators.
5. No guaranteed outcome or inside access
Tender Partner does not guarantee that you will find a suitable opportunity, qualify, submit a compliant response, receive feedback, obtain funding or win an award. No employee, representative, partner or third party may promise a tender award or special access on Tender Partner's behalf. Procurement decisions remain solely with the relevant buyer.
6. Your responsibilities
- Maintain accurate profile, contact and application information.
- Perform your own eligibility, pricing, tax, CSD, compliance, legal and commercial checks.
- Protect account credentials and devices and notify us of suspected unauthorised access.
- Do not scrape, overload, reverse engineer, interfere with, resell without permission, impersonate others through, or use the service for fraud or unlawful activity.
- Do not submit altered purchase orders, false documents or misleading funding information.
7. Privacy and protection of personal information
Tender Partner aims to process personal information responsibly and in line with applicable South African data-protection requirements, including POPIA where applicable. We use reasonable administrative and technical safeguards, but no website, device, email system or internet transmission can be promised to be completely secure.
- Information used locally: saved tenders, profile details, pipeline progress, document drafts, consent and sharing progress may be stored in your browser or device.
- Information you submit: contact, support or funding information is processed to respond to you, provide the requested service, maintain records, prevent abuse and comply with law.
- No sale of personal information: Tender Partner does not sell or rent your personal information for unrelated third-party marketing.
- Marketing: Promotional electronic messages are sent only where a lawful basis or specific consent applies. Marketing consent in the registration prompt is optional and can be withdrawn through Contact Us.
- Limited disclosure: information may be disclosed only where reasonably necessary to service providers acting for us, where you expressly request or consent to a disclosure, to assess a funding enquiry with potential funders or brokers, to protect rights and security, or where required by law. A funding application is not shared with a potential funding partner unless the relevant consent is given.
- Retention and rights: information should be retained only as reasonably required for the purpose, records, disputes or law. You may contact us to request access, correction or deletion, subject to legal and operational limitations.
Do not send passwords, banking PINs or unnecessary identity documents through the general contact form.
8. Purchase-order funding assistance
Tender Partner may act only as an introducer or broker and may help package an enquiry. Funding assistance is available only for qualifying applications in the stated service range of R150,000 to R10 million and remains subject to valid PO verification, commercial assessment and funder approval. Funding is not guaranteed. Fees, interest, security, repayment obligations and funder conditions must be separately disclosed and accepted before any transaction.
9. Official domain and impersonation warning
The official website is https://tenderpartner.co.za. A different spelling, additional word, unusual subdomain or look-alike address is not Tender Partner unless it redirects to the official domain and is confirmed through contact details published on the official site. Communications should be trusted only when the address is listed on the official Contact Us page. Report suspected copies, phishing, guaranteed-award claims or impersonation through the Contact Us page.
10. Third-party websites and documents
Official-document links, buyer email addresses, WhatsApp, public data sources and other external services are controlled by third parties. Tender Partner does not control their availability, security, accuracy or terms. Opening a third-party link is at your discretion, and its own privacy and usage terms apply.
11. Availability, changes and liability
We may maintain, update, add, restrict or remove features and may experience interruptions. To the maximum extent permitted by law, the service is provided on an “as available” basis without a promise that every record, alert, estimate, document or deadline is complete, current or error-free. Tender Partner is not responsible for a user's missed deadline, disqualification, bid cost, pricing decision, lost profit or reliance on an estimate where the user did not verify the official source. Nothing in these Terms excludes liability or rights that cannot lawfully be excluded.
12. Intellectual property and user material
The Tender Partner name, interface, branding, original text, workflow and software are protected to the extent permitted by law. Government notices and third-party documents remain subject to their respective rights. You retain rights in material you create or upload and give Tender Partner only the permission reasonably needed to provide the feature you request.
13. Changes, termination and South African law
We may update these Terms when the service, law, risk or business model changes. Material updates may require fresh acceptance. Continued use after notice and acceptance means the updated Terms apply from their effective date. You may stop using the service at any time. These Terms are governed by South African law, subject to any mandatory consumer or data-protection rights.
Questions, privacy requests and legal notices can be sent through the Contact Us page. These Terms are a practical platform disclosure and should be reviewed by a qualified South African legal professional before offering paid commercial services.
